Terms of Service

2) Virtual currency and virtual items

Any virtual coins/credits, boosters, or similar items (“Virtual Items”) have no cash value, are not redeemable for money or anything of value, and cannot be transferred outside the Service except as we explicitly allow. We may modify, manage, regulate, or remove Virtual Items at any time.

3) Accounts and security

• Provide accurate information and keep it updated.
• Keep your login credentials secure; you are responsible for activity on your account.
• We may suspend/disable accounts to protect users, enforce these Terms, or comply with law.

4) Prohibited conduct

• Cheating, exploiting bugs, using bots/scripts, reverse engineering, or interfering with the Service.
• Harassment, hateful/illegal content, fraud, impersonation, or violating others’ rights.
• Buying/selling accounts or Virtual Items, or attempting to monetize gameplay outcomes.

5) Purchases (optional)

We may offer optional in-app purchases or subscriptions for Virtual Items. Purchases are non-redeemable and (to the maximum extent permitted by law) non-refundable once delivered. Prices and availability may change. If you purchase through Apple, Google, or another platform, the platform’s payment terms control billing, taxes, cancellations, and refunds.

6) Intellectual property

The Service, including software, artwork, text, logos, and game content, is owned by Playnzio or its licensors and is protected by intellectual property laws. You receive a limited, personal, non-transferable, revocable license to use the Service as intended.

7) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted, error-free, or secure operation.

8) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND WITHOUT LIMITING YOUR RIGHTS UNDER THE CONSUMER GUARANTEES ACT 1993, PLAYNZIO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT OR (B) NZ$100.

9) Dispute resolution

If a dispute arises, you and Playnzio agree to first try to resolve it informally by contacting contact@playnzio.com with your name, username, and a clear description of the issue, and to engage in good-faith discussions for at least thirty (30) days. If the dispute is not resolved, either party may bring the matter before the Disputes Tribunal of New Zealand (where the claim is within its jurisdiction) or before the courts of New Zealand. Nothing in these Terms limits any non-excludable right you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

10) Termination and changes

We may terminate or restrict access at any time for violation of these Terms, suspected fraud/abuse, or operational/legal reasons. We may update these Terms by posting a new effective date; continued use after changes means acceptance.

11) Governing law

These Terms are governed by the laws of New Zealand, including the Gambling Act 2003, the Consumer Guarantees Act 1993, the Fair Trading Act 1986 and the Privacy Act 2020, without regard to conflict-of-law principles. The parties submit to the non-exclusive jurisdiction of the courts of New Zealand.
